Faulkner type of Government

Jackson has a Faulkner Act form of government. In towns with this type of government you would prepare a petition containing a proposed ordinance or charter change and gather 10% of those who voted in the last election where the Assembly was up (2011). Once the petition is submitted the town council must vote on the change. If the town council does not enact the law it goes up for a vote by the citizens.


The relevant law is 40:69A-1 (et seq). Reading this the requirement may be 15%?

I'm not sure if the law can be used to override state law, but I don't see why not. Towns should be able to adopt more restrictive caps as well.
