It seems like they were not being filled out." This email concludes: “I understand that some of these concerns are not because of you. You have been very helpful. If there’s any problem with your superiors in these matters, please inform me so we can resolve this in the best possible way.” </span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;"><br /></span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;">Above all, you must know of the email dated December 29, sent from CHK to Agri, copied to you as well. The email, although lengthy details a discussion between the Vaad Hakashrus and Beis Din with AgriStar management who were resisting the implementation of the instructions of CHK and includes the following quotes: "the vein in the chuck under the first rib toward the neck, discussed in the meeting, must be removed and the dried blood in the channel of the back of the chuck must be properly cleaned. If fat in that area is bloody it must be removed"; "three properly spaced, horizontal cuts must be made across the vein in the back of the tail"; "staff must be instructed to open the back of the tongue and remove (not cut) the whole blood vein"; "This was the practice in Agristar until recently. </span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;"><br /></span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;">The change back to another method was a serious breach of the trust we place in you"; "The ‘pillars’ that will carry our hechsher must be cleaned on both sides"; "The fat and membrane between the 12th and 13th rib must be completely removed"; "We are troubled by the pushback from the plant even on some of the (by your own numbers), less costly measures, which we requested"; "they had been rolled back without approval or even any notification to the hechsher"; "This type of behavior, is a serious breach of kashrus protocol..." </span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;"><br /></span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;">Are you not aware of the subsequent email from Rabbi Weismandl shlita dated Jan. 1 to the CHK? The email stated: "I personally called up rabbi Greenberg that everything is on review but agri was not willing at the time to implement". The final straw was the conversation Rabbi Weissmandl shlita had this week with one of our representatives, where he asserted that he is the ultimate kashrus authority. (Indeed, this is for us a serious issue. The CHK cannot in full conscience maintain our certification of a place when someone else decides what our kashrus standards should be, and we no longer have the ability to make kashrus decisions as we see fit. This is even more telling in your recent letter. While you are certainly entitled to keep your certification as you see fit, it baffles us that when a kashrus agency decided to remove certification from a plant due to kashrus issues, you come out with a public statement stating that what our Rabbonim said is not true. Only our Rabbonim have the authority to decide what they think is a kashrus issue for the CHK clientele). </span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;"><br /></span></div><div class="separator" style="clear: both; text-align: left;"><span style="font-size: medium;">Yet, in the same conversation Rabbi Weissmandel shlita indicated that if anything does not receive approval from management, it will not be approved. More disappointing was it to learn that the “<em><strong><span style="color: #009900;">Rabbonim</span></strong></em>” who certified the <span style="font-size: x-small;"><span style="color: blue;">[KCL] </span></span> <strong>never</strong> visited any of their certified establishments. The affair under their certification which was being held in a non-kosher facility.<br />

<strong><em><span style="color: #000099;">KASHRUS</span></em></strong> recently discovered a number of such organizations where the “<span style="color: #009900;"><em><strong>Rabbonim</strong></em>”</span> themselves have never seen the operation which they certify, but instead rely totally on the head “<span style="color: #3333ff;"><strong>Mashgiach</strong>”</span> or on their <strong>Kashrus Administrator</strong> to make all “<em><strong>halachic</strong></em>” decisions.<br />

We would be remiss if we do not report to you directly just what we observed of the procedures used at an affair supervised by your <em><strong><span style="color: #000099;">Hashgocha</span></strong></em> organization which was held in a non-kosher establishment. At a recent affair where we were guests, We went into the kitchen with another Rabbi. Having been shown around by the<em><strong> <span style="color: #3333ff;">Mashgiach</span></strong></em> on duty, we had the following concerns which we hope you will address.<br />
<br />
<strong>1.</strong> The <strong><span style="color: red;">non-kosher</span></strong> facility was allowed to leave their <strong><span style="color: #cc0000;">non-kosher</span></strong> utensils out in open view of the waiters and kitchen staff. By utensils, we mean ladles used to serve soup, etc. and eating utensils. Needless to say, with a little preparation these could be kept out of sight of the <strong><span style="color: red;">non-Jewish</span></strong> staff so as not to tempt them to use them. </div>

The <em><strong><span style="color: #3333ff;">Mashgiach</span></strong></em> said to us, “I’ll give you $100 if you find a <strong><span style="color: red;">non-kosher</span></strong> utensil on the floor (in the ballroom).” The <strong><span style="color: #3333ff;">Mashgiach </span></strong>himself goes onto the ballroom floor from time to time to check if utensils are mistakenly used. <strong>This means that the possibility does exist</strong>. It also means that he is not constantly in the kitchen. Then why leave the utensils out at all?! </div>

We understand from your head <strong><em><span style="color: #3333ff;">Mashgiach</span></em></strong> that he had advised the <span style="color: #3333ff;"><em><strong>Mashgiach</strong></em> </span>on duty to allow the eating utensils to remain in hands reach, but covered. Instead, the <strong><em><span style="color: #3333ff;">Mashgiach</span></em></strong> put them 8 feet away, completely uncovered. <strong>Why should this be allowed</strong>? It is inviting trouble.</div>

We also observed some 6-8 <strong>(</strong><span style="color: #990000;"><strong><span style="color: #cc0000;">non-kosher</span></strong>)</span> ladles hanging in full view. It takes a worker seconds to grab one & put it into the soup. (See also #5 that no ladles were marked in any way.) This is one of the reasons why accidentally <strong><em><span style="color: red;">non-kosher</span></em></strong> utensils sometimes (too often) get taken back in error from an affair held at a<em><strong> <span style="color: red;">non-kosher</span></strong></em> facility. (All too common.)<br />

<strong>2</strong>. Since <strong><span style="color: #009900;">a</span></strong>) the affair was fairly large (500 plus guests), <strong><span style="color: #009900;">b</span></strong>) the <strong><em><span style="color: #3333ff;">Mashgiach</span></em></strong> does leave the kitchen to check the floor (ballroom) as well as for personal needs, and <span style="color: #009900;"><strong>c</strong>)</span> <em><strong><span style="color: red;">non-kosher</span></strong></em> equipment is in full hands-reach of the staff, I feel that such an affair requires <strong><span style="color: #3333ff; font-size: 130%;">2</span></strong><span style="color: #009900;"> <em><strong>Mashgichim</strong></em></span>, not just one. <strong>(See # 6.)</strong></div>

<strong>3</strong>. The <strong><em><span style="color: #3333ff;">Mashgiach</span></em></strong> allowed the waiters to use the <strong><span style="color: red;">non-kosher</span></strong> <span style="color: #000099;">(uncovered</span>) <span style="color: #cc0000;">trays</span> for serving hot foods. This is not an accepted procedure anywhere, as far as we know. Should a hot piece of chicken fall onto the the tray <span style="font-size: x-small;">(the waiter would put it back on to the plate)</span>, would that not constitute a serious problem?<br />
<br />
<strong>4.</strong> Only a part of the kitchen was <span style="color: red;"><em><strong>kashered</strong></em>.</span> Quite understandable. However, it seems inappropriate to have different kosher zones spread throughout the kitchen area. Better would be to cover with paper the entire area from the ballroom side until where the kosher food is prepared, not to leave open spaces that are <strong><span style="color: #cc0000;">not kosher</span></strong> between where the food is cooked, prepared & served.. It is so easy for a worker to put a hot pot, utensil, etc. on the nearest space available.</div>

<strong>5.</strong> There were places which the <strong><em><span style="color: #3333ff;">Mashgiach</span> </em></strong>did not <em><strong>kasher</strong></em> which we feel do need <em><strong><span style="color: #009900;">kashering</span></strong></em>. Some counter spaces had raised racks over them. The underside of the raised racks were not kashered nor covered. This presents a “<em><strong><span style="color: red;">zeah</span>”</strong></em> (vapor) problem, one which kashrus agencies do know to address. It could also be a problem of actual food leftovers, because no-one even bothered to examine the underside of the racks. See also next paragraph.</div>

We also noted a pole in the middle of the production area which we felt should have been kashered, not just washed, and/or should have been draped with some material. The pots and pot covers do touch this pole while they are hot. We were told by your head <em><strong><span style="color: #3333ff;">Mashgiach</span></strong></em> that since there are so few dairy ones, only the dairy utensils are marked. Although <em>Shulchan Aruch</em> advises marking one type of utensils, the common procedure today, wherever I observed, is to mark both dairy & meat serving utensils, especially if catering in<strong> <span style="color: red;">non-kosher</span></strong> facilities also, & paint does wear off. We must be able to distinguish between the caterer’s kosher utensils & the facilities <strong><span style="color: red;">non-kosher</span></strong> utensils.</div>

While we were waiting, we saw some of the staff go to another room, eat <strong><span style="color: red;">non-kosher pizza</span></strong>, bring the boxes into the kitchen & then resume serving, with no washing of hands between eating the<strong> <span style="color: red;">non-kosher pizza</span></strong> & serving a <em><strong><span style="color: #3333ff;">glatt kosher</span></strong></em> meat dinner. The <strong><em><span style="color: #3333ff;">Mashgiach</span> </em></strong>did not (realize) respond until the problem was pointed out to him. Then he asked only one or two workers to wash. This is an additional reason why we feel that the affair needs another <em><strong><span style="color: #3333ff;">Mashgiach</span></strong></em>.</div>

On the contrary, I will be attacked with ridicule from many sides. But what can I do? A fire is burning within me and hopefully within thousands of Jews like me…<span style="color: #990000;">A fire</span>, which cannot be extinguished.<br />

The <span style="color: #cc0000; font-size: 130%;">Kashrus</span> question has recently been discussed in the Yiddish press, but only one side of the question, viz. <strong><em>concerning unscrupulous purveyors & butchers who sell treifos or questionable products <span style="color: #000099;">without a reliable hechsher</span> or with a false one.</em></strong><br />
<br />
The<span style="color: #3333ff;"> religious press</span> is silent about this problem, perhaps because of the honor of the Rabbis, or, perhaps, because of other …. reasons. <strong>The honor of the Rabbis is dear to me too. But, the honor of the Torah which is lying in the garbage, <span style="color: #000099;">and the honor of the truth, which is trodden under foot, is dearer to me</span>.</strong> <span style="font-size: 130%;"><span style="color: #990000;">Where there is <em>Chilul-Hashem</em> we do not impart honor to a Rabbi, I, therefore come forward with an accusation.</span></span><br />

I accuse many Rabbis, <span style="color: #000099;">Kosher certifiers</span> & their Rabbis, who grant <span style="color: #000099;">hechsherim</span>, who knowingly or otherwise, or out of neglect, permit insects & non-kosher meat & other allegedly kosher products to be processed & sold under their stamp of approval both wholesale & retail; <span style="color: black;">the seller is an unscrupulous person with a <em>Torah</em> sanction.</span><br />

<span style="color: #cc0000; font-size: 130%;">I accuse!</span> </div>

Many Rabbis & <em>Roshei Yeshiva</em>, who although they themselves have no part in the <em><strong>hechsherim</strong></em>, nevertheless, know about them & still remain silent, <strong>at times may even be indirectly sanctioning them.</strong> <span style="font-size: 130%;">There is a sort of mutual reciprocal agreement to keep quiet & sanction each other </span><span style="color: #000099;"><span style="font-size: 130%;">including their false </span><span style="font-size: large;">hechshe</span></span><span style="color: #000099; font-size: large;">rim</span>. Perhaps it’s because they wish to avoid <em>Chilul-Hashem</em>. <span style="color: #990000;">They forget that where there is <em>Chilul-hashem</em> we do not impart honor to a Rabbi etc.</span><br />

The very great Rabbis, <em>Roshei Yeshiva</em>, the leaders of our people, because of internal strife. These disputes are not for the sake of heaven; <span style="color: #cc0000;">if one says something is prohibited the other must say it is permissible,</span><strong> if one says something is contaminated the other must say it is pure</strong> (vidu’y Erev Yom Kippur). It is impossible to bring order & reliability to the chaotic<b> </b><em><span style="color: #3333ff;"><b>kashrus</b> </span></em>situation, especially &<span style="font-size: 130%;"> <span style="font-size: 100%;">including the <em><span style="color: #3333ff;"><b>kashrus</b></span></em> standards of infestation checking, meat and poultry.</span><br />
<span style="color: #cc0000;"></span></span><br /><span style="font-size: 130%;"><span style="color: #cc0000;">I accuse!</span></span></div>

The Rabbis, <em>Roshei Yeshiva</em> etc. <strong>because of whose negligence; the laws of <em><span style="color: #000099;">chalav- akum</span></em> have virtually been forgotten</strong>. I know that there were <strong><span style="color: #990000;">(not any more, due to <em>chalav treifa</em>)</span></strong> various heterim for this, but they apply only when it is i m p o s i b l e to obtain <em><strong>chalav-yisroel.</strong></em> In our situation, however, with a little concerned effort of the individuals, order could be brought to this chaos, and “if one can be good, why should he be bad?”<br />

Our orthodoxy, for sleeping the sleep of <em>Choni Ha’Maagil</em>, who slept seventy years. They are completely unaware of what is happening around then and how our strongest ramparts are being smashed by our internal foes. <strong><span style="color: #3333ff;">They are unaware that all our holy traditions & <em>takanos</em> are being trampled underfoot</span>,</strong> that our three thousand year old heritage has all but completely disappeared. Yet, Orthodoxy sleeps, but how much longer?<br />

The very great Rabbis, <em>Roshei Yeshiva, Rabei-im & Menhalim</em> etc. <span style="color: #000099;">don’t you see what has become of your youth?</span> Don’t you know that Jewish children have become tramps, gamblers, gangsters, candidates for the electric chair, and all kinds of “ist’s” <strong><span style="color: #cc0000;">only because they have been raised on insects, neveilos & treifos R”L</span></strong>, yet you sleep, but how much longer?<br />

Don’t you know that going to the mikvah every day to purify yourself will be to no avail? Not even all the waters in the world can help, with a <em>sheretz-tamei</em> (a carcass of a creeping thing), not in your hand, but inside of you! And when you daven every morning and evening, or when you learn your daily shiur or seder, don’t you know that the breath that emanates from your mouth is the breath of sin? <span style="color: #000099;">Because it reeks of insects, neveilos & treifos!</span> </div>

I know that you will reply, “ Jacob is small & poor”. But look what Jacob’s brother on East Broadway has accomplished, how he erected a fortress through the poor laborers, a fortress against Judaism, because he has united forces. Yet you sleep & do nothing, but how much longer?<br />
