The Supreme Court realized that at a certain stage (what ever that stage is 40 days, heart beat, etc.) the fetus is a living viable human being, and abortion is just plain cold blooded murder, for want of a better word. All those involved should be charged with Homicide.

A fetus is not viable at 40 days, nor is is viable just because it has a beating heart. Perhaps someone or someones need to check the actual definition of the word.
Homicide for 40 days a little too far.
It's up to the states
Besides they seem to have ruled minimum 15 weeks -105 days
