Bertolli Extra Virgin Olive Oil EVOO 7 million dollar settlement class action suit

Deoleo USA Inc. has reportedly agreed to pay $7 million to settle a class action lawsuit alleging it made misrepresentations about Bertolli olive oil.
Deoleo USA Inc. has reportedly agreed to pay $7 million to settle a class action lawsuit alleging it made misrepresentations about Bertolli olive oil.
According to the Bertolli class action lawsuit, Deoleo misrepresented Bertolli olive oil as being “Imported from Italy” and that it qualified as “extra virgin” olive oil through the “best by” date.
Seven plaintiffs from Arkansas, California, Florida, New York, New Jersey and North Carolina allege claims for violations of deceptive practices laws in their states and assert claims for unjust enrichment.
In their motion supporting preliminary approval of the Bertolli olive oil class action settlement, the plaintiffs urge the judge to certify a nationwide Class of consumers, because Deoleo’s alleged misrepresentations affect consumers uniformly throughout the United States, and because the laws of all 50 states are substantively identical to the laws of at least one of the states represented by the plaintiffs. The judge had previously certified two Classes of California consumers.
The plaintiffs note that Deoleo has already removed the phrase “Imported from Italy” from its products and will not use similar phrasing unless the oil is entirely derived from olives grown and pressed in Italy.
Deoleo has also reportedly started bottling its “extra virgin” olive oil in dark green bottles to protect the product from light degradation. Further, the plaintiffs say that Deoleo agrees to stricter testing protocols during the bottling process, to shorten the “best by” period, and to disclose the date of harvest on every bottle of Bertolli Extra Virgin Olive Oil to help ensure the product meets “extra virgin” standards at the time of sale and use.
Class Members of the proposed Bertolli settlement include anyone in the United States who purchased Bertolli Extra Virgin Olive Oil since May 23, 2010 and anyone who purchased Bertolli olive oil labeled as “Imported from Italy” between May 23, 2010 and Dec. 31, 2015.
Under the terms of the proposed Bertolli olive oil settlement, each Class Member will be entitled to a cash refund of up to $7.25 per bottle purchased. No proof of purchase will be required for Class Members submitting a claim for up to five bottles.
Plaintiff Scott Koller initially filed the Bertolli olive oil class action lawsuit in May 2014. Bertolli repeatedly attempted to escape the litigation, but its motions to dismiss the Bertolli class action lawsuit were denied.
Koller asked a judge to grant Class certification to the Bertolli olive oil class action lawsuit in October 2015. In August 2017, the court certified two Classes of California consumers.

Some kosher certified apple juice is commonly filtered with beef gelatin filters

Kashrus question;

I have an apple juice with a Heimish Hashgocha and a Halal certification, can I be comfortable that they do not use beef gelatin filters because it does have the Halal certification?  The Halal certifiers do have chemists on staff, they would never allow beef gelatin filters. The Heimish one? We don't know.

Bingo, Some hashgocha labels are false.
Bingo keeps on having infested product, refuse to remove them.
Misleading labeling.
Repackaging items with wrong and misleading information.

All of their chocolates not in original packaging should be considered Dairy /Milchig.
Do not buy any confectionary item that has glazing.
Beware of their Halavah.
Their challah dough must have challah taken.
Don't rely on the labeling of any of their re-packaged items.

Shiduch crisis- What's the story with pictures?

My daughter recently entered shidduchim, and I find myself increasingly livid that girls are expected to send pictures of themselves to the boy’s family or – worse – the boy himself.
When I was dating, no one needed a picture. When a friend or relative told the boy (or his mother) that the girl was cute or good-looking, it was sufficient. Do we demand proof – say, a report card – that a boy is a good learner or that a girl works hard? No, we trust the person setting them up. The boy and girl can get a deeper appreciation of each other while dating.

Why, then, are looks an exception? Why must that be proven? Pressure to provide a photo makes many a girl feel awful. It only adds to her gnawing sense that she is a commodity, not a person with a neshama.
Besides, who looks at these pictures? I’m told only boys’ mothers look at them, but if so, the whole arrangement strikes me as a little creepy. Do mothers know what their sons find attractive? And if boys are looking at the pictures, how is it tzenu’ah for a young man to stare at picture after picture of dolled-up girls?
The truth is that pictures often don’t even properly capture a person as he or she comes across in real life. I know I, for one, would have hesitated to go out with my husband had I seen a picture of him beforehand.
I’ve heard that some mothers want to see a picture of the girl to ensure that she is tzenuah. But that hardly makes sense since anyone can dress as tniusly as she needs to for a snapshot.
So why, then, do we demand pictures? What’s the worst that can happen if a boy goes out without seeing a picture and then discovers that he is not attracted to the girl despite the great recommendation he received? At least, many girls who are not getting dates in our picture-only world would be able to get them and gain untold confidence in the process.
Obviously, once they meet, the boy will see the girl. I’m not suggesting that girls be hidden. But there is a proper way to redt shidduchim that maintains the dignity of our daughters.
Many have suggested that I just get on board – that there’s no use in fighting the inevitable. But I’m taking a stand. It’s not right. Where will this end – with requiring girls to provide full-body photos (which, by the way, is already starting to happen)?
I refuse to submit a picture of my daughter for shidduchim, and I ask others to join me. I can’t do this alone. I call upon mothers and fathers to stand with me. If you have a daughter in shidduchim, don’t provide a picture. If you have a son, tell the other party that you do not want to see a picture. Rabbis and rebbetzins, please lecture about more respectful ways to set people up.
Finally, shadchanim: Please rethink how you operate. I know your parnassah currently revolves around sending families picture-bedecked resumes, but if we all band together, we can change the way we approach shidduchim, which certainly will be a tremendous zechus for all of us – especially singles hoping to soon stand under a chuppah.

Update: ALERT: Royal Clothing Bekeshes may be Shatnez

Due to all of the false comments by Royal clothing affiliates, they are not to be trusted in their clothing re: shatnez or any of their other statements.

Others are considering a complete boycott of these clothing manufacturers. It will work if we publicize some new names of reliable clothing manufacturers.

put on notice of a pending lawsuit for "consumer fraud" to be filed in Federal Court.

We met with all of the Dayonim of those that are certifying the Shatnez Lab of Williamsburgh. All the Dayonim were asked indivuidually if they know the practical part to distinguish linen and wool?, they all responded they have no clue.

I offered to teach them, they refused.

Royal wants to hide behind that Bais Din.

Who would purchase a bekeshe from Royal with that serious issue of Shatnez? We wouldn't.

Every kosher certifier & Rav Hamachshir should be completely transparent in stating clearly,what percentage of product is physically checked, If it's checked prior to washing, after washing.

If they are NOT willing to be transparent in that information, we would not use their product.

Making an affair, Wedding, Bar-Mitzvah

Dear Rabbi Shain,

I just married off my last child and am very happy. The problem that I have was and still is the catering hall. and the Rav Hamachshir.

The chosen's parents insisted on this hall and we did not object. I asked the caterer for the phone number of the Rav Hamachshir. Six weeks later, I asked, again for the phone number. A few days later, the Rav Hamachshir called me back and left a message on my phone. He said that he cannot talk, it was erev Shabbat and he would not be answering the phone number. I finally touched base with him the next week.
 
The place the chosen's parents chose was a treif place that had a kosher caterer in it. I told the Rav Hamachshir that I am not comfortable with him using treif glasses in a Kosher establishment. I wanted new glasses for my simcha. He cited me the Shulchan Aruch, about the difference of opinions between the Rama and the Mechaber. I told him that I am not Sephardi and I hold from two sets of glasses in my house. He told me that there are many poskim that hold from using glass for both and he ridiculed me for not listening to them. I reminded him of the g'morra in Chulin that prohibits someone for making fun of someone because he holds from a certain halachic position.

I told him that I cannot hold by a catering hall that has less standards than my own house. I will never bring in a treif or milchig glass and put it into a soapy basin with meat dishes, or put it into a dishwasher with fleishic dishes, like he does. He refused to listen. Afterwards, he called the caterer. The caterer then called my wife and told her that I or anyone else was not allowed in the kitchen.

I spoke to my Rav. He called up the place and spoke to them. The owner refused to budge and told my Rav, flat out, that no one goes into the kitchen and that 'either you trust the Kashrus or you don't'. 

I spoke to a number of other Rabbonim afterwards. I am fully aware that the soap in the dishwasher makes in pagum and there might be a heter to use it, but none of the Rabbonim that I told would do the same things in their house. All the Rabbonim that I spoke to left after the Chupa, after telling me previously that they would stay until after Sheva Berachot. I could not tell the guests what I did, relying of different psak halachot, but I did not eat anything at the wedding - I brought my own food, drink and cups. I did not want to stop the chaseneh.

I spoke to the Maitre d during the affair and asked to see the mashgiach. He refused.

I am heartbroken at what happened. The Rav Hamachshir is a tremendous name and the hall is a well known hall. I was there many times previously, based on the name of the Rav Hamachshir but personally witnessed multiple affairs happening there, both Kosher and treif, at the same time. Never did I think that they used the same cups.

People have to know that  places that are treif should not have a Kosher caterer, unless there are separate glasses, at the very minimum. If they are really smart, they should insist to use only Kosher caterers.

I had a conversation with the Rav Hamachshir a few years ago he probably does not remember it. . He claimed that he only bought items that he personally checked out, and it has a chassidic or heimishe hechsher. I asked him about Coca Cola. He started yelling at me, saying that I was not allowed to ask that or question what he does.

How much worse is it?

As she stood in front of her 5th grade class on the very first day of school, she told the children an untruth. Like most teachers, she looked at her students and said that she loved them all the same. However, that was impossible, because there in the front row, slumped in his seat, was a
little boy named Teddy Stoddard.

Mrs. Thompson had watched Teddy the year before and noticed that he did not play well with the other children, that his clothes were messy and that he constantly needed a bath. In addition, Teddy could be unpleasant.

It got to the point where Mrs. Thompson would actually take delight in marking his papers with a broad red pen, making bold X's and then putting a big "F" at the top of his papers.

At the school where Mrs. Thompson taught, she was required to review each child's past records and she put Teddy's off until last. However, when she reviewed his file, she was in for a surprise.

Rav Avigdor Miller on Nachal Chareidi


Q:
There has been talk in Eretz Yisroel about the frummeh agreeing to join the IDF in separate regiments called nachal chareidi. What does the Rav think about this?

A:
Some people are proposing to take frum boys into the army in frum regiments. You should know that it's a shtus, a complete foolishness. The army is made lichatchilah for the purpose of changing the minds of the boys while in the army. The purpose of the army is to make the youth into Israelis. This is something that their leaders have said long ago. And it's well-known by those who understand things. And we don't want our children to become Israelis. We want them to remain Jews.

All this talk is only a ploy that they're using now to deceive the frummeh into entering the army. The truth is that the Am Yisroel has to keep out of the army. We have to maintain our privilege, as many other countries maintain, that Rabbinical students are patur from the draft, that they should be exempt from the military draft. And let's continue to fight for that, and not to yield and not to listen to the meisisim and meidichim who are talking about frum regiments for the frum boys.
