What is the Halachic issue regarding this issue?

When Rav Breuer was asked about a similar problem in the King Solomon Cemetery in Clifton, NJ, he felt it wasn't an issue. after many years it was discovered there was a leaking municipal water main causing the flooding, not ground water.
